This Site Readiness Schedule forms part of the Steelo Terms and Conditions of Business.
In accordance with the Steelo Terms and Conditions of Business, in this Site Readiness Schedule, “Services” means any services provided by Steelo or a Subcontractor in relation to the Steel Products, including a Site Survey, and delivery, lifting, offloading and installing Products as identified on the Quote or otherwise agreed by Steelo and Buyer.
Buyer’s responsibility
It is Buyer’s responsibility for ensuring that the Site is ready, safe, accessible and is suitable to park the delivery vehicle and provide the Services, including to offload or lift the Products as the case may be and in particular that the parking space is close to the Site. Buyer should ask Steelo for details of the proximity requirements if the parking space is not on Site.
Vehicle Proximity
If in Steelo’s reasonable opinion the delivery vehicle cannot be safely parked on or sufficiently close to the Site, then Buyer is responsible for transporting the Products from the location where the delivery vehicle can safely stop to the Site. Steelo is not liable for any damage to property that occurs during the provision of the Services. Buyer must give Steelo at least 2 (two) Working Days’ notice if there are any special requirements for delivery for example, required delivery time and/or parking issues or obstructions and Steelo shall use its endeavours to comply with such requirements.
Parking costs
Buyer is responsible for any parking or vehicle related costs at the Site, including but not limited to parking requirements, penalty charge notices, and parking tickets. For the avoidance of doubt, all parking fines at the Site incurred by Steelo shall be paid by Buyer immediately on notice.
Completion of other works
Buyer must ensure that all works, arrangements, conditions and access required for Steelo to carry out the Services safely and efficiently have been completed and made available before Steelo attends the Site. This includes, without limitation, ensuring that:
- suitable access, parking, loading, unloading and working areas are available for Steelo’s vehicles, operatives, plant, lifting equipment, subcontractors and installation teams;
- all openings, supports, padstones, foundations, bearings, working areas and access routes are complete, suitable and ready for use;
- all necessary preparatory works have been completed, including any demolition, removal, trimming, exposing, dismantling, supporting, protecting or making-good required to allow the Products to be delivered, moved, lifted and installed;
- any walls, joists, brickwork, structures, finishes, materials, stored items, services, cables, pipework, utilities, hazards, obstructions or restrictions that may prevent, delay, restrict or be affected by Steelo’s works have been removed, relocated, isolated, protected, clearly identified or notified to Steelo in advance; and
- the Site is free from any condition, omission, obstruction, restriction, hazard, lack of access, lack of preparation or other matter which may prevent, delay, disrupt or make more difficult Steelo’s provision of the Services.
Notification
Buyer must notify Steelo as soon as possible if there is any risk that the Site may not be ready, safe, accessible or suitable for the date Steelo has agreed to provide the Services. Failure to notify Steelo in reasonable time may result in additional charges.
Failure to comply
If Steelo attends the Site and, notwithstanding the list above, if in Steelo’s reasonable opinion, the Site is not ready, safe, accessible or suitable for the Services to proceed safely and efficiently, Steelo may, without liability to Buyer, cancel, suspend, delay, abort or rearrange the Services. Without prejudice to any other rights or remedies available to it, Steelo shall be entitled to recover all reasonable costs, expenses and losses incurred as a result, including but not limited to administration time, estimating time, site survey costs, drawing or modelling time, design coordination, project management time, production planning, materials ordered, steel purchased, cutting, fabrication, supplier costs, subcontractor costs, transport costs, storage costs, and loss of production capacity. Such sums shall be payable immediately on demand.
